1. Acceptance
By accessing or using Amber Toon (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service.
These Terms form a binding agreement between you and Simarai, MB ("Amber Toon", "we", "our", "us"), a private limited company registered in the Republic of Lithuania (company code 307591676, VAT LT100019762213), with registered office at J. Janonio g. 12A-1, LT-92252 Klaipėda, Lithuania. Simarai, MB is the legal entity operating the Amber Toon Service.
2. Eligibility
To use Amber Toon you must:
- Be at least 18 years old.
- Have the legal capacity to enter into a binding contract in your country of residence.
The Service is offered in the European Union, the European Economic Area, the United Kingdom, the United States, Canada, and Australia. If you access the Service from any other jurisdiction, you do so on your own initiative and the Service is provided to you on an "as is" basis with no representations as to its suitability or legality in your country.
3. Service description
Amber Toon is a digital subscription library of original, hand-illustrated webtoons and comics. We provide vertical-scroll episodes across genres — including romance, drama, fantasy and more — with new chapters released regularly. Some episodes are available to read for free; the rest are unlocked through a paid subscription.
All stories, characters and events depicted on Amber Toon are entirely fictional. Any character shown in a mature or romantic context is a fictional adult aged 18 or older, and no depiction is intended to represent any real person. Amber Toon is an entertainment service; it does not provide professional, medical, legal, financial or other advice of any kind.
4. Account
You sign in to Amber Toon using a magic-link email — we do not store passwords. You are responsible for keeping access to your email account secure. Anyone with access to the email address on file can sign in to your Amber Toon account.
A single Amber Toon account corresponds to a single email address. Sharing an account with other people is not permitted (see Section 7).
If you believe your account has been accessed by someone else, contact us at contact@ambertoon.com immediately.
5. Subscription terms
When you subscribe to Amber Toon, you unlock the full library, get new releases first, and read ad-free. You agree to the following pricing and renewal terms:
- 3-Day plan — $1.95 USD, auto-renews every 3 days.
- 7-Day plan — $3.95 USD, auto-renews every 7 days.
- 2-Week plan — $6.95 USD, auto-renews every 2 weeks.
Each plan auto-renews at the listed price at the end of each billing period until you cancel. You will be charged at the time of signup and again on each renewal date thereafter.
- You may cancel at any time from your account settings or by emailing contact@ambertoon.com. We process cancellations within one business day.
- Cancelling stops future renewals but does not automatically refund the most recent charge; see the Refund Policy for refund terms.
Prices are quoted in US dollars. Local taxes (e.g. VAT) may be added at checkout depending on your country of residence; the total amount payable will be shown before you complete payment.
6. Cancellation and refunds
You can cancel your subscription at any time. Cancellation stops future charges; it does not automatically refund past charges. The full refund terms — including your statutory rights as an EU consumer — are set out in our Refund Policy.
7. Acceptable use
When using Amber Toon, you agree not to:
- Scrape, crawl, or use any automated means to access or extract content from the Service.
- Reverse-engineer, decompile, or attempt to derive the source code of the Service.
- Share your account credentials or magic-link emails with anyone else.
- Copy, resell, redistribute, or publicly display Amber Toon's content (including episodes, illustrations, artwork, and story text).
- Use the Service to harass, threaten, or harm any other person.
- Use the Service in any way that violates applicable law.
We may suspend or terminate accounts that we reasonably believe are violating these acceptable-use rules.
8. Intellectual property
All content provided by Amber Toon — including episodes, illustrations, artwork, cover images, story text, brand marks, and the structure of the Service itself — is owned by Amber Toon or licensed to us. You receive a personal, non-exclusive, non-transferable, non-sublicensable license to access and read this content for your own personal, non-commercial use while your subscription is active.
You retain ownership of any text you submit to the Service (for example, support messages). By submitting that text, you grant Amber Toon a limited license to store and process it for the sole purpose of operating the Service and responding to you. We do not sell or share your submissions with third parties for marketing purposes.
9. Content and mature themes
Amber Toon publishes fictional stories, some of which contain mature themes intended for adult audiences. All content is a work of fiction. By using the Service you confirm that you are at least 18 years old and that you consent to viewing mature fictional content where it appears. If you do not wish to view such content, do not access the relevant titles.
10. Limitation of liability
To the fullest extent permitted by applicable law:
- Amber Toon's aggregate liability to you under or in connection with these Terms is limited to the total fees you have paid to Amber Toon in the twelve (12) months preceding the event giving rise to the claim.
- Amber Toon is not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, even if Amber Toon has been advised of the possibility of such damages.
Nothing in this Section limits or excludes:
- Liability for fraud or fraudulent misrepresentation.
- Liability for gross negligence or willful misconduct.
- Liability for death or personal injury caused by Amber Toon's negligence.
- Any other liability that cannot be limited or excluded under applicable law (including, for EU consumers, rights under the Consumer Rights Directive 2011/83/EU and the Digital Content Directive 2019/770/EU).
11. Indemnification
You agree to indemnify and hold Amber Toon harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party rights — except to the extent such claims arise from Amber Toon's own gross negligence or willful misconduct.
12. Termination
We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms. Where the violation is curable, we will give you notice and a reasonable opportunity to cure before terminating, except in cases of material breach or repeated violation.
You may terminate your relationship with Amber Toon at any time by cancelling your subscription and requesting deletion of your account (see our Privacy Policy for the deletion process).
13. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Lithuania. Any dispute arising under these Terms shall be resolved by the competent courts of Klaipėda, Lithuania, except that EU consumers retain the right to bring proceedings in their country of residence.
EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
14. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will notify you by email and update the "Last updated" date at the top of this page. Continued use of the Service after the update takes effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription before they take effect.
